Under the Fair Labor Standards Act, covered nonexempt employees must be paid overtime for hours worked in excess of 40 in any given workweek, with the overtime rate set by law at no less than one and one-half times the employee’s “regular rate” of pay. But what exactly is the “regular rate” of pay? Does the regular rate include performance, referral, or holiday bonuses? What about employer awards programs? When must the cost of benefits – or cash in lieu of benefits – be included?
