What It Means

The Guide reviews the requirements of the National Labor Relations Act, which protects political speech related to employment issues; and federal non-discrimination laws, which allow employers to regulate offensive speech in the workplace.

The Guide also contains a high-level summary of state and local laws that further protect employee speech.

What You Should Do

Now that election season is in full swing, employers may wish to review the Guide to ensure they don’t run afoul of the major areas of risk related to workplace policies on political discourse.
