NLRB Reports Big Increase in Unfair Labor Practice Charges in FY 2024

What's New

The number of unfair labor practice charges filed with the National Labor Relations Board increased for the fourth consecutive year in fiscal year 2024, NLRB enforcement data show.

The 21,300 ULP charges filed from October 1, 2023—September 30, 2024, are the highest number filed since FY 2016.

The Board made 259 final administrative determinations in FY 2024, up from 246 the year before. The number of NLRB cases decided by the U.S. Courts of Appeals more than doubled from 22 to 51 (a gain of 132%), while the percentage of Board decisions that federal appellate courts fully enforced dropped from 86% to 69%. Another 20% of such appeals were remanded in full to the Board.

What It Means

The current NLRB consists of three Democrats appointed by President Biden, one Republican appointed by President Trump, and one vacancy. Generally, NLRB enforcement activity tends to increase when Democrats compose the Board majority.
