On February 23, 2021, the Department of Labor
sent a draft of proposed revisions to regulations interpreting the Fair Labor Standards Act's joint employment provisions to the White House Office of Management and Budget for review. The Trump Administration
finalized its revisions to the regulations in January 2020, although they were immediately
challenged in federal court. This is the first substantive proposed rule sent from DOL to OMB during the Biden Administration.
