OFCCP Audits And Financial Recoveries Increased In FY 2023

January 6, 2024

What's New

There were notable increases in the number of audits conducted by the OFCCP and the monetary remedies it obtained in 2023, according to an analysis of OFCCP data performed by CWC.

OFCCP completed 1,056 supply-and-service (i.e., non-construction) compliance evaluation audits in fiscal year 2023, a 17.6% increase over the 898 audits it completed in FY 2022. With regard to financial remedies, OFCCP obtained $17.3 million for discrimination victims last year, representing a more than 46% increase from FY 2022’s $11.8 million total.

CWC based its analysis on OFCCP’s online summary of its enforcement accomplishment data, OFCCP’s Freedom of Information Act Library, and DOL’s Data Catalog.

What It Means

OFCCP is taking a more activist enforcement stance in both the number of audits it performs and the amount of monetary remedies that it is awarding to complainants.

What You Should Do

Employers should be aware of the uptick in OFCCP activity and take steps to avoid adverse consequences by ensuring that they are complying with all OFCCP rules. CWC members who desire help can contact CWC staff through MemberAssist at [email protected].
