Massachusetts Issues Details About February 1st EEO-1 Reporting

What's New

Massachusetts has issued FAQs explaining employers’ obligation to report workforce data under the state’s new Salary Range Transparency Act that includes EEO reporting requirements.

Under the law, employers with 100 or more employees in Massachusetts must submit a copy of their most recent EEO-1 Report to the state annually by February 1 (or the next business day).

The FAQs explain that:

  • Covered employers must submit the report to the Massachusetts Secretary of State in PDF, JPG, or PNG format through this web portal. The web portal allows an employer to include additional information, such as company name, in a message field.
  • Employers do not have to modify their EEO-1 Report(s) before sending a copy to the state.
  • The submission currently does not include pay data.

The Massachusetts Executive Office of Labor and Workforce Development told CWC that companies can elect to submit either their Consolidated Report or Establishment Reports for Massachusetts locations. Alternatively, companies may create a separate report covering Massachusetts employees if it provides the same information as EEO-1s.

What It Means

Massachusetts soon will have demographic information at the EEO-1 job category level for companies that have at least 100 employees in the state. The state plans to publish an aggregated report of submitted data but will not publish any individual company data.

What You Should Do

Employers should collect their most recent EEO-1 Reports filed in 2024 and submit them via the state’s web portal by Monday, February 3, 2025. This year, reports will be accepted until then because February 1 is a Saturday.
