President Trump’s recent Executive Order, Addressing DEI Discrimination by Federal Contractors, introduces a new compliance framework for federal contractors and subcontractors that differs in important ways from long‑standing contractor compliance models. The Order moves quickly, operates through mandatory contract clauses, and relies on agency‑specific enforcement rather than a single centralized regulator.

This interactive, members‑only discussion will focus on the practical and operational implications of the new Executive Order, including:

  • How this Executive Order differs from prior DEI‑related directives, including the shift away from centralized enforcement models familiar to federal contractors
  • The scope of prohibited “racially discriminatory DEI activities” and how the Order’s definitions may be interpreted and applied in practice
  • What the new contract clauses require, including government access to records and documentation
  • Enforcement considerations, including contract remedies and False Claims Act materiality
  • Practical steps contractors can take now to assess existing programs and prepare for implementation
