CWC Interstate: October 2024 Update

What's New

CWC presents an update of state and local workplace compliance requirements that have occurred since September.

What It Means

Employers should be aware of these developments:

  • Ban the box—Under the Fair Chance Ordinance that took effect October 10 in San Diego County, Calif., an employer must conduct an individualized written assessment showing an adverse relationship between a job and a job applicant’s criminal history before rejecting an applicant. The new Ban the Box ordinance in Prince George’s County, Md., prohibits employer inquiries about a job applicant’s criminal history until after the initial interview.
  • Pay transparency—New Jersey’s S2310/A4151, if signed by the governor, will require employers to include compensation and benefits information in job postings.
  • Medical marijuana—An ordinance in Pittsburgh, Pa., prohibits discrimination based on a person’s status as a medical marijuana patient.
  • Paid leave—Effective November 21, Massachusetts is requiring employers to let employees use earned sick time for the physical or mental health needs of themselves or their spouse related to pregnancy. New York changed the employee contribution rate and benefits amounts under its Paid Family Leave Law. 
  • Pay stub requirements—Maryland updated its FAQs on the amended Pay Stub and Pay Statement Law that took effect October 1. 
  • Captive audience ban—Minnesota employers must display a captive audience rights poster.
