Highlights From CWC’s 2024 Compliance, Diversity, and Inclusion Conference

What's New

CWC held its 2024 Compliance, Diversity, and Inclusion (CD&I) Conference in Reston, Va., on October 2 and 3. Representatives from member and prospective member companies engaged with CWC staff during several sessions.

Session topics included:

  • "A New Risk Landscape for Compliance and Diversity Programs,” about some employers’ reshaping of their CD&I programs since the Supreme Court struck down race-based affirmative action in college admissions.
  • “Future Impact of New Federal Race/Ethnicity Data Standards,” about changes to the federal government’s collection and evaluation of race and ethnicity data.
  • “Rooney, Ricci, And Race: A Post-Harvard Revisiting, about the Supreme Court’s likely response to an employment-related DEI or affirmative action program.
  • “Just How Intelligent Is It? Paradigms for Assessing AI Risk, about the use of artificial intelligence in employment decisions.
  • “Structuring Affirmative Action Plans (AAPs) for a Remote Workforce,” about the practical challenges of aligning remote workers with AAPs.
  • “Practical Suggestions for Managing OFCCP Audit Risks,” about increasing the odds of a successful audit outcome.
  • “Lessons Learned: The Wrong Ways Employers Pursue Pay Equity,” about the dos and don’ts of designing pay equity analyses.

What It Means

There is a new risk landscape for affirmative action compliance and DEI programs in the wake of the Supreme Court’s 2023 decision striking down race-based affirmative action in college admissions and the flurry of legal and political challenges that followed.
