Illinois Pay Reporting Recertification Notices Mistakenly Request Data From Wrong Year

The Illinois Department of Labor (IDOL) is issuing notices to remind employers that they must obtain a new Equal Pay Registration Certificate (EPRC) in 2024 if they obtained their initial EPRC in 2022. However, some of IDOL’s recertification notices to employers erroneously stated that employers submitting recertification applications in 2024 should use employee data for calendar year 2022 to complete the pay data report. CWC confirmed with IDOL that the reference to 2022 data was a mistake and that employers recertifying in 2024 should use employee data from calendar year 2023.

What It Means

Employers with 100 or more Illinois employees were required to have applied for an EPRC by March 23, 2024, and they are required to resubmit an EPRC application every two years after that. The recertification deadline is approaching for employers that obtained an EPRC in 2022. 

Under the amended Illinois Equal Pay Act (ILEPA), IDOL can provide current employees, upon request, anonymized data regarding that employee’s own job classification or title and the pay for that title or classification. This right to review makes it even more important for employers to ensure the accuracy of the pay data that they submit to IDOL.

What You Should Do
