Comments On Proposed EEO-1 Rescission Due August 24, 2026

The Equal Employment Opportunity Commission (EEOC) has formally published a Notice of Proposed Rulemaking (NPRM), “Removal of Reporting Requirements,” seeking to rescind the requirement that employers file the annual Employer Information (EEO-1) Report. The proposal was first announced earlier this week shortly after a public meeting on the same topic, during which the EEOC commissioners voted 2-1 to approve the NPRM.

The EEOC is soliciting public feedback on its proposal, with written comments due to the agency by August 24, 2026. CWC intends to file comments. The EEOC is also holding a public hearing on the matter, scheduled for August 11, 2026, at 10:00 a.m. EDT.

What It Means

Publication in the Federal Register represents the first of several steps toward one of the most significant changes to federal equal employment opportunity reporting requirements in decades. If implemented, the proposal would also eliminate the associated requirements for employers to collect and maintain the workforce demographic data used to prepare the EEO-1. Please keep in mind that this proposal was expected, and no immediate changes have occurred.

What You Should Do

CWC will be holding a roundtable on August 13, 2026, at 2:00 p.m. EDT to discuss the contents of the NPRM and its practical implications. Registration is free for all members.
