President Trump Sends Bipartisan NLRB Nominees To Senate As August Quorum Deadline Looms

On April 13, President Trump nominated Republican James Macy and Democrat David Prouty to serve on the National Labor Relations Board. Without Senate action before August 27, the Board is set to lose its quorum when Prouty’s current term expires. Macy has 40 years of experience practicing management-side labor and employment law in Milwaukee. During the Trump Administration, he has held several senior roles at the Department of Labor, including Acting Wage and Hour Administrator.

Prouty has served as an NLRB member since July 2021. Previously, he served in senior roles representing labor unions, including as General Counsel of Service Employees International Union Local 32BJ and the Major League Baseball Players Association.

What It Means

If confirmed, the Board’s composition and term end dates will be:

  • James Murphy, Chair (Republican) – December 16, 2027
  • Scott Mayer (Republican) – December 16, 2029
  • James Macy (Republican) – August 27, 2030
  • David Prouty (Democrat) – August 27, 2031

Confirmation would ensure a Republican majority throughout 2027. It would also make it more likely that the Board revisits Biden-era precedent on issues such as card check recognition, employer free speech, and standards for challenging handbook policies and workplace rules.

By nominating one Democrat and one Republican, the Administration may increase the chances of a bipartisan Senate deal to expedite confirmation.
