DOJ Sues SpaceX Over Alleged Immigration Violations, SpaceX Sues Back

In a legal spat that is garnering widespread attention, the U.S. Department of Justice and rocket and satellite company SpaceX have sued each other over whether the company’s hiring practices violate U.S. immigration law.

On August 23, 2023, DOJ filed an administrative lawsuit alleging that the company owned by entrepreneur Elon Musk violated the Immigration and Nationality Act by refusing to hire refugees and asylees. DOJ’s complaint, which will be heard by an administrative law judge, alleges that the company discouraged refugees and asylees from applying for jobs and refused to hire them because of their citizenship status.

On September 15, 2023, SpaceX sued the Chief Administrative Law Judge, the ALJ assigned to the case, and Attorney General Merrick Garland in the U.S. District Court for the Southern District of Texas. SpaceX’s suit challenges the constitutionality of DOJ’s administrative proceeding while defending the company’s hiring practices.

What It Means

DOJ’s lawsuit against SpaceX serves as a reminder to employers that the INA contains robust anti-discrimination provisions and that DOJ is prepared to enforce them. SpaceX, in turn, has indicated its willingness to fight DOJ’s allegations, including a constitutional challenge to the very administrative process under which DOJ is suing.
