Massachusetts Enacts Law To Require Pay Ranges in Job Postings

What's New

Massachusetts has become the latest state to require covered employers to post salary ranges in their job listings. H.4890, signed into law by Governor Healey on July 31, 2024, will require employers with 25 or more employees in Massachusetts to disclose pay ranges in job postings and provide a pay range to employees to whom they offer a transfer or promotion. The pay range requirements will take effect July 31, 2025.

Beginning February 1, 2025, employers with 100 or more employees in the state will have to submit annual, industry-based aggregate pay data categorized by race, ethnicity, sex, and job category. Employers may satisfy this requirement by submitting their federal EEO-1 Employer Information Report to the state.

The state attorney general will enforce the law through declaratory or injunctive relief and fines.

What It Means

With this legislation, Massachusetts joins other states that have enacted pay transparency legislation—including California, Colorado, Hawaii, Illinois, Maryland, Minnesota, New York, Vermont, and Washington state.

What You Should Do

Covered employers should review their job postings to ensure that they contain the required pay information. Covered employers also should ensure compliance by any recruiters that advertise job opportunities on their behalf.
