OFCCP Financial Settlements in FY 2024 Q1-Q3

What's New

The Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) has announced 16 formal settlements of enforcement actions against federal contractors during the first three quarters of fiscal year 2024, which spans the time period from October 1, 2023, to September 30, 2024.

CWC has created a resource that summarizes the settlements. Our chart identifies the contractor, OFCCP region, allegation(s), protected class(es), number of class members, alleged technical violations, monetary amount, and type of agreement—that is, whether the settlement took the form of a Conciliation Agreement or an Early Resolution Conciliation Agreement (ERCA). 

What It Means

The chart indicates that OFCCP is on track to complete approximately the same number of settlements this year that it completed last year. Sixty percent of settlements occurred in the fourth quarter of FY 2023, so CWC predicts a surge of settlements in the fourth quarter of FY 2024, with a significant number of ERCAs.
