EEOC Moves FEPA Lists From Regulations To Agency Website

What's New

The EEOC has issued a final rule revising its procedures for recognizing Fair Employment Practice Agencies (FEPAs). FEPAs are state and local agencies that enforce employment discrimination laws and participate in EEOC worksharing and charge-processing arrangements. As of July 16, 2026, the agency no longer maintains lists of designated and certified FEPAs in its regulations. Instead, those lists will be published and updated on the EEOC's website (please note that these lists have not yet been posted on the designated website).

What It Means

This is an administrative change only. The rule does not alter FEPA designation criteria, EEOC charge-processing procedures, worksharing arrangements, or employers' substantive obligations under federal equal employment opportunity laws.

According to the EEOC, moving the lists online will make it easier to keep them current and provide the public with more accurate information about which state and local agencies qualify as FEPAs.

What You Should Do

No immediate action is required. Employers that occasionally need to confirm whether a state or local agency is a designated FEPA should use the EEOC's website rather than its regulations as the authoritative source for that information.
