EEOC Prepares To Rescind EEO Reporting Requirements

The Equal Employment Opportunity Commission (EEOC) has asked the White House Office of Management and Budget (OMB) to approve publication of a proposed rule that would rescind the requirement for employers to file EEO-1 Reports. The proposal would also rescind similar reporting requirements that apply to labor unions, state and local governments, and certain public schools. OMB review is an early procedural step, but marks the beginning of a process that could lead to significant changes to longstanding workforce data reporting obligations.

What It Means

Before the proposal can take effect, OMB must complete its review and the EEOC would then need to publish the proposed rescission in the Federal Register for notice and comment. Timing is uncertain and could take weeks or months. Even at this early stage, however, the proposal introduces meaningful uncertainty for employers about the 2026 EEO-1 reporting cycle and whether the agency intends to proceed with data collection on its usual schedule.

What You Should Do

Employers should not assume data collection and reporting obligations have changed unless and until the EEOC takes further action. At the same time, employers should watch developments closely, as the agency’s proposal creates uncertainty about both the timing and structure of the 2026 EEO-1 collection cycle and whether the agency will open the collection at all.
