OFCCP Updates Form CC-305 Expiration Date

What's New

The Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) has updated its Voluntary Self-Identification of Disability (Form CC-305) with a new expiration date of May 31, 2026. Form CC-305 expired on April 30, 2026, and as we noted at the time, employers could continue using Form CC-305 after April 30th. It’s likely that the expiration date will be updated every 30 days while the Office of Management and Budget (OMB) considers OFCCP’s formal request to extend Form CC-305 and the agency considers more sweeping changes to the self-identification requirement.

What It Means

The expiration date, established by OMB, does not alter contractors’ obligations to comply with OFCCP’s regulations. Contractors may either: (1) update Form CC-305 in their own systems periodically when a new expiration date is announced; or (2) continue using the now-expired form displaying the April 30, 2026, expiration date. According to OFCCP, “the forms are still valid for use while the information collection is under review by OMB.”

What You Should Do

Contractors should continue to comply with OFCCP’s disability self-identification regulations unless and until they are formally revised. Continuing to use Form CC-305, even the version that expired on April 30, complies with OFCCP’s requirement to invite employees and applicants to voluntarily self-identify as having a disability.
