Poland’s Pay Transparency Provisions Effective December 23, 2025

What's New

Amendments to Poland’s Labor Code, which implements the Pay Transparency provisions of the European Union (EU) Pay Transparency Directive, became effective on December 23, 2025.

Earlier this year, Poland amended its existing Labor Code, becoming the first EU Member State to transpose the Directive’s pay transparency requirements and prohibitions on salary history inquiries. EU Member States have until June 7, 2026, to “transpose” (meaning “implement” or “adopt”) the Directive. Each Member State is required to adopt the Directive’s requirements through its own legislative process.

What It Means

After December 23, 2025, employers in Poland must give all job applicants information about the expected pay for a role before their first interview. Employers have the option to disclose the pay in job postings but are not required to do so. The transposition also requires all posted job titles to be gender neutral and establishes a salary history ban, which prohibits employers from asking candidates about their current or previous pay.

Poland has not yet adopted the Directive’s requirements related to gender pay gap reporting or pay transparency to current employees. A working draft is making its way through the legislative process and is expected to be adopted before the June 2026 deadline.

What You Should Do

Employers that intend to hire an employee in Poland should ensure protocols are in place to comply with the requirements listed above.
