CWC Hosts Member Roundtable On EEOC’s Rescission Of Harassment Guidance

CWC recently convened a members-only roundtable to discuss the EEOC’s rescission of its 2024 Enforcement Guidance on Harassment in the Workplace and the practical implications for employers. Participants noted that few member organizations relied on the guidance because their internal policies and expectations already exceeded federal minimum standards.

The discussion also addressed employee relations considerations, including how employees may interpret the rescission and whether it could be perceived reducing workplace protections. Participants explored how employers are navigating compliance in the absence of a single, consolidated federal reference point and what the rescission may suggest about the EEOC’s future enforcement posture.

What It Means

Employers reported that the rescission does not alter their policies or expectations, which remain more protective than federal requirements. Several employers emphasized the importance of thoughtful internal communication to reassure employees that workplace protections and standards of conduct remain unchanged.

The discussion underscored that employer standards continue to be driven by organizational values rather than shifts in EEOC interpretive documents.

Employers should internally reinforce that harassment standards and protections remain unchanged despite the rescission. Employers should also consider whether existing communication plans appropriately address employee concerns and maintain confidence in existing workplace protections.
