CWC Urges EEOC To Strengthen Performance Measures In Strategic Plan

On July 19, CWC submitted comments on the Equal Employment Opportunity Commission's (EEOC) draft Strategic Plan for Fiscal Years 2026–2030. In our comments, we generally praised the draft as an improvement over prior plans, citing its streamlined structure, focus on quality investigations and conciliations, attention to charge intake, and more appropriate systemic enforcement metrics.

We also urged the EEOC to strengthen the Plan by measuring mediation effectiveness, expanding charge-intake metrics, resuming public reporting on charge-processing times, and reinstating a timeliness goal for resolving discrimination charges. We recommended that the Commission continue monitoring field-office quality-review results and assess whether the new $1 million systemic-relief benchmark creates unintended consequences.

What It Means

Strategic Plans may be internal management documents, but they matter because they shape the metrics that guide agency operations and signal priorities to stakeholders. The metrics EEOC chooses can affect how resources are allocated, how quickly charges move through the system, and how the agency evaluates success.

Our comments emphasize that EEOC’s performance measures should promote timely charge resolution, effective mediation, transparent reporting, and consistent quality across field offices.

What You Should Do

Employers that track EEOC policy and enforcement should watch for the final Strategic Plan and consider how its metrics may affect charge processing, mediation, and systemic investigations.
