OFCCP Seeks To Renew Veteran AAP Requirements

The Office of Federal Contract Compliance Programs (OFCCP) has announced its intent to move forward with a renewal of the recordkeeping and reporting burdens arising from the agency’s regulations implementing Section 4212 of the Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA). Pursuant to federal Paperwork Reduction Act (PRA) procedures, OFCCP must solicit public comments on its renewal request before sending a formal request to the Office of Management and Budget (OMB) for approval.

In a supporting statement accompanying the announcement, OFCCP indicates there will be no changes to the longstanding VEVRAA requirements that have been in place since September of 2013. OFCCP’s announcement follows the agency’s recent proposed rule that would make minor administrative changes to the VEVRAA regulations, but leave all legacy affirmative action requirements intact.

What It Means

The announcement makes clear that OFCCP intends to move forward with VEVRAA’s longstanding recordkeeping, reporting, and enforcement requirements. This includes, for example, the contents of the written affirmative action program, annual assessment of outreach, data collection and metrics, and regular communications to state agencies, union officials, subcontractors, and other key stakeholders.

What You Should Do

Comments to OFCCP are due by March 9, 2026, and CWC intends to submit written comments. We encourage CWC members’ feedback on OFCCP’s proposals, which we will consider and incorporate as appropriate into CWC’s comments. OFCCP’s proposal will also be a featured topic at CWC’s upcoming Workplace Policy Conference, which will be held virtually on March 18-19, 2026.
