Drug Testing

While there is no federal law that regulates employer drug testing in the private sector, various states have enacted laws that limit how, when, and for what purpose an employer may require an employee or applicant to submit to a screening for illegal drugs. Many of these laws have been on the books for some time, however, as the number of states legalizing marijuana continues to grow, states are beginning to take a fresh look at their regulations and even prohibit employers from testing for marijuana use. In CWC’s State Drug Testing tool, members can find specific state laws relating to employer drug testing and any applicable nuances related to areas such as timing, notice, and confirmatory testing.
