Many state and local jurisdictions have enacted legislation that restrict and/or prohibit the use of settlement agreements, non-disclosure agreements, and separation and severance agreements to require confidentiality of facts associated with allegations of discrimination, sexual harassment, and/or sexual assault. These laws vary, often substantially, from jurisdiction to jurisdiction and often require very specific language and/or time frames for review by parties to such agreements.
