Military Leave

The federal Uniformed Services Employment and Reemployment Rights Act (USERRA) requires employers to provide time off and job reinstatement to employees called into activity duty in the U.S. armed forces, including the reserves and National Guard. Many states have enacted laws that extend USERRA’s protections under state law to include employees called into state active duty and increase the duration of leave required to be afforded. CWC’s State Military Leave tool summarizes the various state laws on military leave, including the amount of leave required to be provided and any applicable notice and benefit requirements.
